1. Eligibility & Customer Account
By placing an order on dmatcha.us, you (a) represent that you are at least the age of majority in your state of residence and (b) agree to provide current, complete, and accurate purchase and account information.
2. Order Acceptance
All orders are offers to purchase and are subject to our acceptance. We may refuse or cancel any order at any time for reasons including product availability, errors in pricing or product information, suspected fraud, or violation of these terms. If we cancel after charging you, we will refund the full amount charged for the cancelled items.
3. Pricing, Taxes & Promotions
Prices are shown in U.S. dollars and may change without notice. Applicable sales taxes are collected at checkout. Promotional codes and offers are subject to their stated terms and cannot be applied retroactively or combined unless expressly permitted.
4. Payment
We accept the payment methods shown at checkout and may use third-party processors. By submitting a payment, you authorize us (and our processors) to charge the total order amount, including taxes and shipping.
5. Shipping, Risk of Loss & Title
Title and risk of loss pass to you upon our delivery of the products to the carrier. Delivery dates are estimates and not guaranteed. Please review the Shipping Within the United States section above for current rates and processing times.
6. No Resale
Purchases are for personal use or gifting only and not for resale or export. We may limit or cancel quantities per person, per household, or per order.
7. Product Information, Freshness & Storage
We take care to describe products accurately; however, minor variations in color or packaging may occur. Tea is a perishable food product; to maintain quality, store in a cool, dry place away from heat, light, moisture, and strong odors. Best-by dates, if shown, are guidance rather than safety dates.
8. Allergens & Dietary Information
Some items may be processed in facilities that also handle common allergens. If you have specific dietary concerns, please contact us at info@dmatcha.com before purchasing.
9. Returns & Damages
As detailed above, all food products are final sale. If an order arrives damaged, defective, or incorrect, notify us within seven (7) days of delivery at info@dmatcha.com so we can arrange a replacement or refund at our discretion.
10. Limited Warranty; Disclaimers
EXCEPT AS REQUIRED BY LAW, PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, D:MATCHA USA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR PURCHASES OR USE OF THE PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.
12. Force Majeure
We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, labor disputes, acts of government, supply chain disruptions, carrier delays, or telecommunications failures.
13. Governing Law & Dispute Resolution
These Terms of Sale are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of state and federal courts located in Wyoming for any dispute not subject to informal resolution. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

We may update these Terms of Sale from time to time. Changes are effective when posted on this page and apply to orders placed after the “Last updated” date above.
